By using our Products, you agree that we can show you ads and use your personal data to help determine which ads to show you, to send you emails regarding job offers and to send candidates profiles to Yachts for job positions which they have listed with VIP Yacht Crew (DBA of Thorn Group LLC).
1.The services
VIP Yacht Crew (DBA of Thorn Group LLC) provides an introduction advisory service to Yachts searching for there right candidate when recruiting for job positions on board the Yacht. Candidates can register via our online system creating a profile which is available for admins and potential employers. These Terms govern your use of VIP Yacht Crew (DBA of Thorn Group LLC), and the other products, apps, services, technologies, and software offered (VIP Yacht Crew Products or Products), except where expressly stated that separate terms apply. These Products are provided to you by Vip Yacht Crew (Division of Thorn Group LLC). We do not charge candidates for personal use of Products covered by these Terms unless they are businesses or organizations. In this case, they pay us for the advisory services, membership available through our website www.vipyachtcrew.com, business tools and apps. Our mission is to give our clients potential qualified candidates and the related introduction of those who posit the necessary skill set to be considered for employment through our strategic advisory services and to give candidates the possibility to be hired by those clients (Yacht Crew and Yacht Owners), advising which candidates might be more suitable for each position.
• Worldwide access. To grant a worldwide access, we need to store and distribute content and data including outside your country of residence.
• Communication. We offer you the possibility to express yourself in your profile and to decide which informations are shared with us.
• Promotion. We show you ads, offers, and other sponsored content to help you discover services, products and content offered by the many businesses and organizations that use Products.
• Safe community. We constantly spend our self to detect misuse of our Products, harmful conduct towards others, and situations where we may be able to help support or protect our community. If we learn of content or conduct like this, we will take appropriate action to grant you a safe community. There will be no tolerance for objectionable content or abusive users.
• Research. We engage in research to improve our Products. This includes analyzing the data we have about our users and understanding how people use our Products.
2.Funding of service and candidates commitments
Instead of paying to use the services we offer, by using the Products covered by these Terms, you agree that we can show you ads that business and organizations pay us to promote. We collect and use your personal data in order to provide the services described above to you. In order to provide our Products, we need you to make the following commitments:
You agree to:
– Create only your own account;
– Use your real name;
– Use a real profile picture of yourself
– Provide accurate information about yourself;
– Do not share your password;
– Do not give access to your account to others nor transfer your account to anyone
else;
You also confirm, under your responsibility, that:
– You are not under 18 years old;
– You are not a convicted sex offender;
– You are prohibited from using our Products under applicable laws.
In order to use our Products, you agree not to engage in the conduct described that may breach with our Terms of Service or policies nor to facilitate or support others in doing so. In detail:
– You will not do anything that is unlawful, misleading, discriminatory or fraudulent.
– You will not access or collect data from our Products or attempt to access data you do not have permission to access.
– You will not infringe or breach someone else’s rights.
– You will not upload content containing viruses or malware nor do anything that could cause a malfunction to our Products.
In case of violation we can remove or block content that is in breach of these provisions without informing you. To provide you our services and Products you agree to give us the following permissions:
3. Candidate Profile and data/content use permission
You give us permission to use your name, profile picture, curriculum vitae and any information and/or documents/videos you have uploaded on our online system, for clients in regarding to job positions for you to be a potential candidate.
You (Candidate) agree to, and unconditionally and unequivocally consent to:
– VIP Yacht Crew can use/share your Candidate Profile, including without limitation, your curriculum vitae, documents/photos/videos, to any and all Subscribers, Clients and our 3rd party security company; and the use of any such information by any Subscriber, Clients and/or 3rd party security company. When you share or upload documents or videos using our Products it may be protected by intellectual property laws. You own the intellectual property rights and nothing in these Terms takes away the rights you have to your own content. To provide our services we need you to give us some legal permissions (known as a “license”) to use this content. This is only for the purposes of providing and improving our Products and services and to find the right yacht job for you. So when you upload content that is covered by intellectual property rights on or in connection with our Products, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, distribute, copy, publish, disclose, process, stream, store, retain, publicly perform or display, transmit, scan, reformat, modify, edit, frame, translate, excerpt, adapt, create derivative works and distribute, any content you have provided (including, without limitation, your Candidate Profile), in connection with the service or the use or promotion thereof. This license will end when your content is deleted from our systems.
VIP Yacht Crew agrees to allow the candidate full access to their Profile, as maintained on the System, in order to enable them to view and edit their personal information. Candidates expressly warrant that they will only upload information and data in respect of their own Candidate Profile.
We reserve the right at our sole discretion to remove, withdraw or require to be amended any information which we consider inappropriate, inaccurate, illegal, immoral, offensive, obscene or in respect of which we receive any complaint or objection. We further reserve the right at our sole discretion to decline to distribute or forward or to suspend or remove your Candidate Profile, documents or any part thereof. If you do not access your Candidate Profile in any four (4) week period and click on the “check in” button, your profile will be considered dormant and, although your information will still be stored in our System, it will not appear in any Clients and/or Subscribers search results. When you obtain employment, you should access your profile and check in telling us you no longer looking for work, which will make your profile dormant. You may re-activate your profile at any time by clicking on the “check in” button on your profile page and tell us you are actively looking for a job. If you wish to have your Candidate Profile temporarily unavailable to Clients and/or
Subscribers, you may do so at any time by indicating that you are not looking for work in your Candidate Profile. You can also delete content individually but if you wish to have your Candidate Profile permanently removed from the database, you may do so at any time by contacting us in writing, by email, in each case at the address provided on our website (www.vipyachtcrew.com). You acknowledge that we may retain archived copies of any information you have previously provided notwithstanding the temporary or permanent removal of your Candidate Profile and it may continue to exist on our systems in the following cases: – if immediate deletion is not possible due to technical limitations; – if your content has been used by other user in accordance with this license and they have not deleted it; – if immediate deletion would restrict our ability to: investigate or identify illegal activity or violations of our terms and policies; or comply with a legal obligation, such as the preservation of evidence; or comply with a request of a judicial or administrative authority, law enforcement or a government agency. In each of the above cases, this license will continue until the content has been fully deleted. If you use content covered by intellectual property rights that we have and
make available in our Products, we retain all rights to that content (but not yours). You can only use our copyrights or trademarks (or any similar marks) as expressly permitted or with our prior written permission.
We agree to use reasonable endeavours to prevent your personal information from being accessed by parties other than us, Subscribers/Clients and our third party security company. If, despite such efforts, any information is nevertheless accessed by a third party other than us, any Subscriber/Client, or our security company, you hereby release us from any liability for any loss or inconvenience you may suffer in consequence of such unauthorized access and from any other consequences thereof howsoever caused. We give no warranty or representation as to the suitability, performance or character of any subscribers/Clients who may use the System. Before accepting a position, you must undertake your own due diligence and exercise your own judgment as to the Yacht Clients character and/or suitability. In no circumstances shall we be liable (whether in contract or tort) for any loss of profits, your failure to secure employment, loss of business, depletion of goodwill and/or similar losses, loss of contract, loss of or corruption of data or information, or any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses suffered by you.
You agree to indemnify VIP Yacht Crew in relation to any loss and/or damage suffered, including any direct, indirect, incidental, special, consequential and/or punitive damages, arising in consequence of your Candidate Profile or otherwise in consequence of your breach of any of your obligations under these Terms.
4.Candidates rights and obligations as per The MLC 2006 (Maritime Labour Convention).
VIP Yacht Crew does not charge seafarers (candidates), directly or indirectly, in whole or in part, any fees for the registration of their details upon gaining employment. To work as a seafarer you need to be over the age of 16. There are limitations involved with working onboard between the ages of 16-18. Candidates aged 16-18 are unable to undertake any position in the Galley and other restrictions may apply to conditions of
employment. Vip Yacht Crew does not accept Candidates which are under the age of 18. Proof of age will need to be presented to Vip Yacht Crew uploading a copy of ID. We (Vip Yacht Crew) assist Candidates in their job search to the best of our ability and we do not use any means or mechanisms or lists intended to prevent or deter seafarers from gaining employment.
To work as a seafarer candidates need to be medically fit. We do requests candidates to upload in our online system an original copy of a national statutory medical certificate (ENG1 or any other accepted national seafarer medical). Candidates are always responsible for ensuring that their personal information is published on their profile and that is accurate and up to date. Candidates are warrant that their Profile, including Curriculum Vitae and certificates are true and correct and that the information on their Curriculum Vitae reflect the reality of their life experience and qualifications. Copies of all certificates and documents will need to be provided and Vip Yacht Crew will do all the necessary checks to verify the authenticity and validity of the documents by contacting the agency or training provider. We reserve the right to suspend, withdraw or otherwise make unavailable a Candidate Profile if any information contained therein is false or inaccurate.
Candidates will need to provide VIP Yacht Crew with references written or stated in their curriculum vitae with up to date contact information and accept that those referees will be contacted by VIP Yacht Crew.
VIP Yacht Crew uses a security and criminal record check using a service called Crew Pass which is a certified company conducting background checks on each Candidate before the advisory takes place.
We (VIP Yacht Crew) inform the candidate of the salary, leave allowance and benefits onboard the yacht to the best of our knowledge. As a seafarer, the candidate, needs to be aware that they are entitled to a contract from the employer called Seafarer Employment Agreement (SEA). Before entering in an agreement with the Yacht the candidate should always have the opportunity to examine and seek advise about the
SEA.
5.Notification of terms changes
We will notify you when we make changes to our Terms and give you the opportunity to review the revised terms and choose to continue using our Products. Once any updated Terms are in effect, you will be bound by them if you continue to use our Products. If you do not agree to our updated Terms, you can delete your account at any time.
6.Suspension and Termination of the account
If, at our sole discretion, you have breached our Terms or Policies or infringed other people’s rights or we are required for legal reasons, we may suspend or permanently disable access to your account. If you delete or we disable your account, these Terms shall terminate as an agreement between you and us, but the license will remain into force.
7.Disputes
You agree that in case of any dispute arising from matters related to this Terms and Conditions or other policies for the use of our Products, the applicable law will be the law of Wyoming, USA and the dispute shall be subject to the exclusive jurisdiction of the courts of Wyoming, USA.
8.Miscellaneous
Our commercial or business products are governed also by supplemental terms. If you use any of these products, you will be requested to agree to supplemental terms that will become part of our agreement with you. The headings of various clauses in these Terms are inserted for convenience of reference only and shall not affect the construction of the relative provisions. If any portion of these Terms is found to be unenforceable, the remaining portion will remain in full force and effect.
